Sending a notice

Write to the agent above. To be effective under 17 U.S.C. § 512(c)(3), your notice has to include all six of these:

  1. Your physical or electronic signature, as the owner of the work or somebody authorised to act for them.
  2. Which work you say was copied. If several, you can list them together.
  3. Where the copy is on this site, specifically enough that we can find it. A link to the post, listing or sticker is the clearest way.
  4. How we can reach you: address, phone and email.
  5. A statement that you believe in good faith that the use is not authorised by you, your agent, or the law.
  6. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are authorised to act for the owner.

A notice missing any of these may not be effective, and we may come back to you for the rest before acting.

If we removed something of yours

You can send a counter-notice to the same agent. Under 17 U.S.C. § 512(g) it needs your signature, what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, and your name, address and phone number with consent to the jurisdiction of the federal court for your district.

If we receive one, we pass it to whoever sent the original notice. Unless they tell us they have gone to court, we may restore what was removed in 10 to 14 business days.

Repeat infringers

Accounts that repeatedly post work belonging to other people lose access, in appropriate circumstances. We count notices we have acted on rather than notices received, so a notice we rejected does not count against anybody.

A word about false notices

Section 512(f) makes anybody who knowingly misrepresents that something is infringing liable for the damages it causes, including the other side's legal costs. Please be sure before you file.
